I hereby request Jackson County Rural Electric Membership Corporation (“Cooperative”) to assist in the location of a cable or fault in underground wiring owned by me. I understand that such assistance will be limited to the use of available personnel and equipment, which can be economically justified by Cooperative management.
Such assistance will be restricted to the use of available personnel and locating equipment for approximately one (1) hour in the field. Fault location work will be scheduled during regular hours at the convenience of the Cooperative and is not to include any excavation or actual repair or replacement work. The Cooperative will not perform any excavation, replacement, or repair as a part of its services.
I further understand that there are technical limitations with the equipment available to the Cooperative and that although the Cooperative will do its best to locate the cable or fault it makes no warranties, guarantees, or assurances, express or implied, of the accuracy of its findings.
I release and agree to indemnify and hold harmless the Cooperative from any and all liabilities, losses, claims, damages, costs, and expenses, including court costs and attorney’s fees, whether brought by any Federal, State, or local governmental entity, by any other third party, or by me, which may arise from the Cooperative’s actions to assist in the location of the underground electrical cables or faults on my property.
